1. Acceptance of Terms

By accessing or using any of the websites operated by Aeromarine Ventures, Inc. ("Aeromarine," "Company," "we," "us," or "our"), including aeromarine.info and mybahamas.travel (collectively, the "Websites"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must discontinue use of the Websites immediately.

These Terms apply to all visitors, users, and others who access or use the Websites, whether for informational purposes, to submit booking inquiries, or to communicate with Aeromarine.

The Websites serve as a central hub for tourism experiences and booking requests in the Bahamas, including but not limited to tours, yacht charters, beach experiences, water activities, and related services offered by Aeromarine and its partner brands ("Services").

3. Use of the Websites

By using the Websites, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. You agree to use the Websites only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Websites.

You agree not to:

  • Use the Websites in any way that violates any applicable federal, state, local, or international law or regulation;
  • Transmit or facilitate the transmission of any unsolicited or unauthorized advertising, spam, or promotional material;
  • Attempt to gain unauthorized access to any part of the Websites or any server, computer, or database connected to the Websites;
  • Engage in any conduct that restricts or inhibits any person's use or enjoyment of the Websites, or which may harm Aeromarine or its users;
  • Use any automated means, robots, crawlers, or data mining tools to access, collect, or extract data from the Websites without prior written consent from Aeromarine;
  • Reproduce, duplicate, copy, or resell any part of the Websites in violation of these Terms.

Aeromarine reserves the right to modify, suspend, or discontinue, temporarily or permanently, any part of the Websites at any time without notice or liability.

4. Booking Requests and Inquiries

The Websites facilitate booking requests and inquiries for tourism services in the Bahamas. Submitting a booking request or inquiry form through the Websites does not constitute a confirmed reservation, contract, or guarantee of service availability.

A booking is only confirmed when Aeromarine or its authorized representative provides written or electronic confirmation, including confirmation of pricing, availability, and applicable terms specific to the requested service.

Aeromarine reserves the right to accept or decline any booking request at its sole discretion. All bookings are subject to availability, applicable terms of service of partner providers, and any special conditions communicated to the customer prior to confirmation.

Prices, availability, and offerings displayed on the Websites are subject to change without notice and do not constitute a binding offer until confirmed in writing by Aeromarine.

5. Communications: WhatsApp, SMS, and Email

When you submit a booking request, contact form, inquiry, or any other form of communication through the Websites, you expressly consent to being contacted by Aeromarine via the following communication channels for the purpose of responding to your inquiry and processing your reservation:

  • Email – to the address provided in your submission;
  • SMS (Short Message Service) – to the mobile number provided in your submission;
  • WhatsApp – to the mobile number provided, if you have WhatsApp installed and active on that number.

By providing your contact information and submitting a request, you affirm that you are the owner or authorized user of the phone number and/or email address provided, and that you consent to receiving communications from Aeromarine through the channels indicated above in connection with your inquiry or reservation.

You may withdraw this consent at any time by notifying Aeromarine in writing at the contact information provided in Section 13 of these Terms.

6. SMS Communications Compliance

Important Notice Regarding SMS: Aeromarine Ventures, Inc. does not send unsolicited marketing or promotional SMS messages. SMS communications are used solely to respond to customer-initiated inquiries regarding reservations and services.

Aeromarine's use of SMS messaging is strictly limited to the following purposes:

  • Responding to booking inquiries or reservation requests submitted by the customer through the Websites or other customer-initiated channels;
  • Confirming, modifying, or following up on an existing reservation or service request;
  • Providing information or logistical updates directly related to a confirmed or pending booking.

Aeromarine does not engage in bulk SMS campaigns, promotional text blasting, or any unsolicited marketing via text message. All SMS communications originate in direct response to a message, inquiry, or form submission initiated by the customer.

Standard message and data rates may apply depending on your mobile carrier and plan. Message frequency will vary based on the nature and status of your inquiry. You may reply STOP to any SMS from Aeromarine to opt out of further SMS responses. For help, reply HELP or contact us directly.

Aeromarine's SMS practices are intended to comply with all applicable telecommunications regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA messaging guidelines, as applicable.

7. Third-Party Services and Partner Providers

The Websites may feature or facilitate bookings for services provided by third-party operators, vendors, or partner brands ("Partners"), including but not limited to yacht charter companies, tour operators, water sports providers, transportation services, and accommodation providers.

Aeromarine acts as an intermediary booking facilitator and is not the direct provider of all services listed or featured on the Websites. Aeromarine does not assume liability for the acts, omissions, negligence, or failure of any third-party Partner to perform their services.

When you book a service provided by a Partner, you may be subject to that Partner's own terms and conditions, waivers, policies, and requirements in addition to these Terms. Aeromarine will endeavor to make such terms available to you prior to booking confirmation.

Links to third-party websites, platforms, or services on the Websites are provided for convenience only. Aeromarine does not endorse, control, or assume responsibility for the content, privacy practices, or accuracy of any third-party websites. Accessing third-party links is done at your own risk.

8. Intellectual Property

All content on the Websites, including but not limited to text, graphics, photographs, logos, icons, videos, audio clips, digital downloads, data compilations, and software, is the property of Aeromarine Ventures, Inc. or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.

The Aeromarine Ventures name, logos, and all related brand names, product names, service names, and slogans are trademarks of Aeromarine Ventures, Inc. or its affiliates. You may not use any such marks without prior written permission from Aeromarine.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Websites for personal, non-commercial purposes only. This license does not include the right to:

  • Reproduce, distribute, or publicly display any content from the Websites;
  • Modify, create derivative works from, or reverse engineer any part of the Websites;
  • Use any content for commercial purposes without the express prior written consent of Aeromarine.

Aeromarine may share your information with Partner service providers to the extent necessary to fulfill a booking or service request. Such Partners are expected to handle your data responsibly and in accordance with applicable law.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Aeromarine Ventures, Inc., its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:

  • Your use of, or inability to use, the Websites or any Services;
  • Any errors or omissions in the content of the Websites;
  • Any unauthorized access to or use of Aeromarine's servers or any personal information stored therein;
  • Any interruption or cessation of transmission to or from the Websites;
  • Any acts or omissions of third-party service providers or Partners;
  • Weather conditions, acts of God, force majeure events, or other circumstances beyond Aeromarine's reasonable control.

The Websites and all information, content, materials, and Services included on or otherwise made available to you through the Websites are provided on an "as is" and "as available" basis without any representations or warranties, express or implied, to the fullest extent permissible under applicable law.

In no event shall Aeromarine's total liability to you for all claims arising out of or related to these Terms or your use of the Websites exceed the total amount paid by you, if any, to Aeromarine in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aeromarine Ventures, Inc. and its officers, directors, employees, agents, licensors, and Partners from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your use of the Websites or any Services;
  • Your violation of any applicable law or regulation;
  • Any content or information you submit through the Websites.

12. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.

Any legal action or proceeding arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

Before initiating formal legal proceedings, both parties agree to attempt in good faith to resolve any dispute through informal negotiation for a period of no less than thirty (30) days from written notice of the dispute.

13. Changes to These Terms

Aeromarine reserves the right to modify, update, or replace any part of these Terms at any time at its sole discretion. Changes will be effective immediately upon posting the revised Terms on the Websites, with an updated "Last Updated" date reflected at the top of this document.

Your continued use of the Websites following the posting of any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates. If you do not agree with the modified Terms, you must discontinue use of the Websites.

14. Severability and Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and Aeromarine with respect to your use of the Websites and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
